Stand with Marc: Fight for Faith and Justice
Marc is a devout Catholic. He worked for a company in Gainesville, Florida called North Central Florida Hospice, Inc. The company goes by the name of Haven. Haven provides hospice care. Marc's job was to help Haven build ties with the community.
During a volunteer workshop, Marc shared his story about his journey into working in hospice. Marc shared about his personal faith and how he felt called by God to do hospice work.
After the workshop, Marc was written up and reprimanded. His crime? He talked about God at work. He had offended a prominent volunteer who was a staunch atheist. Marc's manager told him never to talk about God at work again.So Marc's job was on the line and his faith was under attack. Marc already had a heart condition. And the stress at work made things even worse. He went to his doctor because of chest pain. Marc's doctor advised him that he needed to take medical leave. So, Marc applied and was approved to take Family and Medical Leave Act leave.
Marc took his leave. Days later, on June 28, 2022, Marc went to his cardiologist and failed a stress test. His cardiologist immediately scheduled him for heart surgery to occur on June 30th, prescribed him additional blood pressure medication, placed a heart monitor on him, and advised him to go to the emergency room immediately if he felt any further chest pains.
After leaving the doctor, Marc went to the pharmacy to get a prescription filled for blood pressure medication. But his pharmacist told him that his insurance was declined. Marc was confused. Because he had paid his insurance premium in full for the month of June. The next morning, on June 29th, Haven contacted Marc to inform him that his FMLA leave had been revoked, he had been fired from his job, and his insurance had been canceled.
SanteFe Healthcare owned Haven. But SanteFe also owned Marc's health insurance company AvMed. So they were able to cancel his health insurance -- health insurance that he already paid for. Because Marc no longer had health insurance, his heart surgery was canceled. So, Marc went home to his family where he waited and faced the prospect of dying young.
Fortunately, after a short time, Andreozzi was able to obtain replacement health insurance. But his heart surgery was delayed for two weeks. That was a very long two weeks.
At around this same time, Haven circulated an email throughout Company advising that if anyone saw Marc on campus, they were to call the police -- because Marc was known to be aggressive toward women. That was a lie.
A few days after his heart surgery, while still recovering, Andreozzi received a threatening letter from Haven's lawyers at the prominent law firm Jackson Lewis.
Haevn's lawyers falsely accused Marc of improperly accessing Haven’s database (called Playmaker) and deleting client and prospect contact information. This was a lie. Marc was able to go to a former colleague of his at Haven and obtain proof that he did not improperly access or destroy any documents. After pleading his case to Haven's lawyers, they finally let him alone.
After recovering from his heart surgery, Marc tried to find another job. But he had a non-compete agreement. And jobs that he did apply for didn't pan out -- even after multiple rounds of interviews. Marc believes he has been blacklisted in the broader healthcare and hospice industry.
Will Marc ever get justice? Maybe there's a hope and a prayer. If we're still allowed to say that in this country. If we're still allowed to talk about prayer and faith and God. But that's really all he's got: Hope. Faith. Prayer.Because the deck is stacked against him. Marc is pursuing a case against Haven for religious discrimination, FMLA interference, and defamation. But seeking justice against a big company in America is an uphill battle. Florida courts are notoriously tough places for plaintiffs in these types of cases. Marc will never get a jury trial against Haven because his employment agreement contains a jury trial waiver. There's a good chance his case will get thrown out before trial. And even if Marc makes it to trial, it's unclear if he will ever collect a single dollar. Because Haven has been sold to another big company. So they might get off the hook and face no consequences.
Marc is struggling. Since he couldn't find a job, he went back to school to pursue a Masters of Theology and Christian Ministry from Franciscan University.
