Referral to Arbitration from Court Proceedings

Why spend months (or years) in court when arbitration can resolve your dispute efficiently, privately, and flexibly?

Under Section 13E of the Family Law Act 1975, the Family Court can refer disputes to arbitration—but only with both parties' consent. This means:

A neutral third-party arbitrator decides your case
Faster resolutions than traditional court proceedings
Confidential & private – no public court hearings!
Cost-effective compared to lengthy court battles

What about the final decision?
Once an arbitrator makes an award, it can be registered & enforced like a court order under Section 13H. However, parties can object or seek a review under Sections 13J & 13K in cases of fraud, bias, or legal errors.

Bottom Line? If you and your ex-partner want a quick, cost-effective, and less stressful alternative to litigation, arbitration is worth considering!
